Ugly Toad specialises in web design, web hosting, domain name registration, search engine optimisation. We are based in Canterbury, Kent but have clients from all over Europe.
TERMS OF SERVICE
Ugly Toad provides World Wide Web page hosting. Ugly Toad reserves the right to suspend or cancel a customer's access to any or all services provided by Ugly Toad when Ugly Toad decides that the account has been inappropriately used or otherwise.
SPAMMING
Please also note: Ugly Toad does not allow bulk emailing or unsolicited email of any kind via or in association with domains or websites held on our servers, this includes any volume however large or small. This activity uses resources and annoys customers. Because of this, we (and most ISP’s) are strictly against this in any form.
SERVER USE
Non Reseller Hosting accounts are to be used by the primary owner only. Hosting account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.
Ugly Toad reserves the right to refuse service and /or access to its servers to anyone.
Ugly Toad do not allow any of the following content to be stored on its servers:
Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Ugly Toad.
Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization. Ugly Toad may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available Ugly Toad reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Ugly Toad continues hosting the website for an additional fee.
PAYMENT POLICIES
All accounts are set up on a prepay basis. Although Ugly Toad reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given. If the account is paid annually then renewal payments are collect 1 month in advance of the pre-pay expiration.
Ugly Toad reserves the right to suspend services until any outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.
All bills, invoices and other accounting issues will be sent by email.
All payment is in UK sterling.
(however using PayPal allows you to pay us in UK sterling but get charged in UK£ or US$ or Euro)
PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down Ugly Toad runs a limited number of payment options.
Credit / Debit Cards:
Ugly Toad accepts Mastercard, Visa, Switch and Solo (all processed via PayPal). Credit card use involves a small additional fee.
Cheque / Bank Transfer:
Ugly Toad accepts Cheques and direct Bank Transfers
CANCELLATION AND REFUNDS
Ugly Toad reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes Ugly Toad' terms of service a refund will not be issued in the event of a cancellation.
Customers may cancel their account at any time. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.
Fees charged on a prepay basis are non-refundable. Customers are not entitled to receive a refund unless the service is cancelled by Ugly Toad. In addition some accounts incur set-up fees, these charges are also non-refundable.
INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold Ugly Toad harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Ugly Toad, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Ugly Toad against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Ugly Toad' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Ugly Toad' server.
DISCLAIMER
Ugly Toad will not be responsible for any damages your business may suffer. Ugly Toad makes no warranties of any kind, expressed or implied for services we provide. Ugly Toad disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Ugly Toad and its employees. Ugly Toad reserves the right to revise its policies at any time.
Ugly Toad Domain Name Registration Terms and Conditions
The contract between the Registrant and Ugly Toad includes the following Terms and Conditions.
1) Ugly Toad will consider all requests for domain name registration and accept or reject them in accordance with guidelines set by the relevant naming authorities.
.uk domain registrations must abide by http://www.nic.uk/terms.html
Global domain registrations must abide by INWW terms
2) Upon acceptance of registration requests Ugly Toad will submit names for registration and make full registration upon receipt of payment.
3) The domain name registration period runs for one year (Global) and two years ( UK) from the date of registration. After this initial period you will be invoiced prior to the renewal date at the prevailing renewal rate.
4) Once a domain name has been submitted for registration no refunds will be made by Ugly Toad.
5) Ugly Toad reserve the right to halt the registration or transfer/release of a domain name if any outstanding monies are owed to them by the registrant.
6) Ugly Toad processes domain registration requests on a first come, first served basis. Until the registrant receives confirmation from Ugly Toad that the name has been submitted for registration, there is no guarantee that the domain name requested has been registered.
7) Ugly Toad may cancel or halt domain name registrations under certain circumstances. One of these is if the completion of the registration puts Ugly Toad in conflict with guidelines set by the relevant naming authority.
8) Ugly Toad does not accept any responsibility for the use of registered domain names, especially where there may be conflict over rights to ownership.
9) The registrant agrees that all details submitted in respect of a domain name registration are true and correct.
10) In the event of a domain dispute the registrant must be able to demonstrate that the registration of a domain name and the way in which it is used (directly or indirectly) does not infringe the legal rights of any third party.
11) The registrant indemnifies Ugly Toad from any legal proceedings and costs that arise as a result of the registration of a domain name.
12) Data submitted by the registrant pertaining to the registration of a domain name will not be made available to other organisations and members of the public, apart from that made public by the relevant naming authority.
13) Ugly Toad reserves the right to make alterations to the terms and conditions of domain name registration at any time.
14) Transfers and renewals of domain names will be made under the Ugly Toad terms and conditions of domain name registration in force at the time of renewal or transfer.
15) These terms and conditions constitute the entire agreement between Ugly Toad and the registrant of the domain name. These terms and conditions replace all prior agreements whether verbal or in written form.
These terms and conditions do not affect your statutory rights as a consumer.
